Porsche Track Experience Gift Voucher Terms and Conditions

IMPORTANT INFORMATION

The following information is required to be disclosed under NSW Fair Trading Legislation to all participants based in New South Wales.

Do you need to sign a Release and Indemnity to participate in the Experience?
Yes, participation in an Experience will not be permitted unless you sign all required Release and Indemnity documents at or before the Experience. A copy of the Release and Indemnity is available at (https://porscheevents.com.au/Media/2025 Porsche Track Experience Release and Indemnity.pdf). For further information see clause 6 of these Terms and Conditions.

Is PCA entitled to use your personal information or image?
Yes, by participating in an Experience, you grant PCA the right to use your name, likeness, image and voice in any media for an unlimited period without remuneration in relation to the Experience or for the purpose of promoting any of the PCA’s events or products. For further information see clause 9 of these Terms and Conditions.

Is our liability excluded or limited?
Yes. Should the Experience be cancelled, shortened, altered or interrupted PCA, will not have any liability to you arising out of such cancellation, alteration or interruption, including any travel and accommodation expenses you may have incurred, unless required by law (including under the Australian Consumer Law). PCA reserves the right to cancel an Experience or combine the Experience with another session on the same date or to hold the Experience on another date. Are you entitled to a refund in respect of the Fees or replacement in respect of a Voucher?
Subject to the Australian Consumer Law and any other applicable law, PCA will not provide any refunds in respect of the Fees, or replacement in respect of a Voucher, where (a) you change your mind (b) there is a change in your personal circumstances, (c) you do not attend the Experience that is the subject of your Booking or (d) there is inclement weather or any other unforeseen conditions during the Experience that prevent the Experience from proceeding.

If you cancel your Booking and make a Cancellation Request, a refund (or if you are holding a voucher, a new Booking) will be considered by PCA on a case-by-case basis. If your Cancellation Request is made less than [14] days before the Experience, no refund of the Fee will be given.

Is your personal information disclosed to third parties?
Yes, your personal information is disclosed to third party service providers who assist us in providing the services under these Terms and Conditions, including Dr. Ing. h.c. F. Porsche AG and its related entities, service providers and business partners. Your personal information may also be disclosed where required by law or shared with other entities within the Porsche corporate group (which may be located overseas). These terms and conditions (Terms) apply to all gift vouchers issued by Porsche Cars
Australia Pty Ltd ACN 004 327 048 (PCA) in respect of Porsche Track Precision experiences, offered by PCA (Experience) (Voucher).

The following words have the following meanings:
Australian Consumer Law means Schedule 2 of the Competition and Consumer Act 2010 (Cth) and any equivalent State or Territory legislation.
purchaser means the purchaser of a Voucher.
recipient means the recipient or end user of a Voucher. a Porsche Track Experience, including the Precision, Precision Plus, Performance, Master, GT3 Cup or GT4 Clubsport experiences, offered by PCA.
you means the purchaser and / or the recipient.

These Terms govern your purchase and use of a Voucher. By purchasing or using a Voucher, you agree to be bound by these Terms. If you are taken to be a Consumer for the purposes of the Australian Consumer Law, these Terms are subject to the provisions of the Australian Consumer Law which cannot be excluded, restricted or modified.

After completing the purchase, PCA will either (a) mail the Voucher to the mailing address; or (b) email the Voucher to the email address, provided in the Voucher registration form. The Voucher will detail the steps to redeem it and book the Experience.

Vouchers may only be redeemed for the Experience for which the Voucher was purchased. (Relevant Experience). The Relevant Experience will be listed on the Voucher. Vouchers are not redeemable for any Experience other than the Relevant Experience or any other goods and / or services offered by PCA.

Vouchers are not legal tender and cannot be returned or exchanged wholly or partly for cash. You are responsible for the use of and safety of your Voucher. If your Voucher is lost or stolen, you must report the loss or theft to PCA immediately by emailing trackexperience@porsche.com.au. PCA may, at is sole discretion, replace any lost or stolen Voucher.

It is a condition of purchase that Vouchers must not be purchased for unauthorised re-sale by third parties. If a Voucher is used in breach of this condition, it may, at PCA’s sole discretion and subject to the Australian Consumer Law, be cancelled without refund.

The Voucher is issued in the name of the recipient listed in the Voucher registration form and is non-transferable.

Vouchers are valid for a period of three years from the date of issue, irrespective of the expiry date shown on the Voucher. After the Voucher has expired, it is no longer valid and no refund will be provided if the Voucher has not been used.

You acknowledge and agree that the Experience are subject to separate terms and conditions, including the Porsche Track Experience Terms and Conditions, Porsche Deed of Release and Indemnity, RACQ Code of Conduct and RACQ Covid Safe Protocols (Participation Conditions). The purchaser must procure the acceptance of the Participation Conditions by any person participating in an Experience as any participant must meet the requirements and comply with the obligations set out in the Participation Conditions.

The purchaser consents to PCA collecting, storing, handling and using its personal information to assess its and the recipient’s Voucher registration form, contact it about the Voucher registration form or the Voucher, issue the Voucher, for the purpose of direct marketing about PCA’s products and services and any other purposes set out in PCA’s Privacy Policy. PCA may disclose the purchaser’s and / or the recipient’s information to relevant third parties including Porsche AG (located in Germany) and its related entities, service providers, our business partners and as required by law. The purchasers confirms that it has obtained the consent of the recipient to provide PCA with its personal information. PCA may amend these Terms at any time. If any amendments are made to these Terms, PCA will publish them at https://porscheevents.com.au/Porsche-Track-Experience-Terms-and-Conditions prior to or on the date the amendment will take effect.

These Terms are governed by the laws in force in the State of Victoria and the parties submit to the non-exclusive jurisdiction of the courts of the State of Victoria.
